Quetzi Terms of Service

These Terms of Service are effective as of August 2nd, 2009.

By using the Quetzi.com website you are agreeing to be bound by the following terms and conditions ("Terms of Service").

Introduction

Quetzi gives you the ability to post comments with impunity. That's part of the fun, and part of the function. The following terms are generally just common-sense standards for behaviour.

Note: As with any other website, anything you publish on Quetzi.com is still bound by the constraints of the law. If at any time you use Quetzi.com for illegal purposes, either to publish libel or for any other reason, you may be subject to legal action. If we are informed of any misuse or illegal activity, we reserve the right to reveal your personal details to the appropriate legal authorities.

BY USING QUETZI.COM AND AGREEING TO THESE TERMS AND CONDITIONS, YOU INDEMNIFY QUETZI FROM ANY FEES OR LAWSUITS LEVELLED AT QUETZI AS A RESULT OF YOUR COMMENTS.

Basic Terms

  1. You are responsible for any activity that you post.
  2. You are responsible for keeping your password secure.
  3. You must not abuse, harass, threaten or intimidate other Quetzi users.
  4. You may not use the Quetzi.com service for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.
  5. You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, audio and video clips, links ("Content") that you submit, post, and display on the Quetzi.com service.
  6. You must not modify, adapt or hack Quetzi.com or modify another website so as to falsely imply that it is associated with Quetzi.com.
  7. You must not create or submit unwanted email to any Quetzi members ("Spam").
  8. You must not transmit any worms or viruses or any code of a destructive nature.
  9. You must not, in the use of Quetzi, violate any laws in your jurisdiction (including but not limited to copyright laws).

While Quetzi.com prohibits the above mentioned conduct and content on its site, you understand and agree that Quetzi cannot be responsible for the Content posted on its web site and you nonetheless may be exposed to such materials and that you use the Quetzi.com service at your own risk.

QUETZI.COM IS NOT A MONITORED OR MODERATED WEB SITE. ONCE NOTIFIED OF ANY ALLEGATIONS OF MISUSE, ABUSE, OR OTHER VIOLATIONS OF THIS TERMS OF SERVICE, QUETZI WILL ACT WITHIN A REASONABLE TIME FRAME TO ADDRESS SAID COMPLAINT, BUT CANNOT GUARANTEE THE LEGALITY OR ACCURACY OF ANY MATERIAL POSTED BY ITS USERS.

Anonymity

In accordance with the Quetzi Statement of Purpose, one of the primary goals of the Quetzi.com web site is to allow individuals to speak openly and honestly. To this end, users may choose to participate in discussions ("Threads") anonymously. How we protect user identities is discussed in detail in the Quetzi Privacy Policy.

NOTE THAT USERS WHO POST ANONYMOUSLY ARE STILL RESPONSIBLE FOR THEIR CONTENT, WHICH MUST ADHERE TO THE TERMS DETAILED IN THIS DOCUMENT.

Data Transfer

Because Quetzi.com is a worldwide service based in the United Kingdom, we may be sending your data to and from the European Union. You acknowledge that your personal data may be sent to and from the E.U., and agree to this transfer.

General Conditions

  1. We reserve the right to modify or terminate the Quetzi.com service for any reason, without notice at any time.
  2. We reserve the right to alter these Terms of Service at any time. If the alterations constitute a material change to the Terms of Service, we will notify you via internet mail according to the preference expressed on your account. What constitutes a "material change" will be determined at our sole discretion, in good faith and using common sense and reasonable judgement.
  3. We reserve the right, in accordance with any applicable laws, to refuse service to anyone for any reason at any time.
  4. We may, but have no obligation to, remove Content (including "threads") and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.

Copyright (What's Yours is Yours)

  1. We claim no intellectual property rights over the material you provide to the Quetzi service.
  2. Quetzi undertakes to obey all relevant copyright laws. We will review all claims of copyright infringement received and remove content deemed to have been posted or distributed in violation of any such laws. To make a claim, please provide us with the following:
    1. A physical or electronic signature of the copyright owner or the person authorized to act on its behalf;
    2. A description of the copyrighted work claimed to have been infringed;
    3. A description of the infringing material and information reasonably sufficient to permit Quetzi to locate the material;
    4. Your contact information, including your address, telephone number, and email;
    5. A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
    6. A statement that the information in the notification is accurate, and, under the pains and penalties of perjury, that you are authorized to act on behalf of the copyright owner.
